Todd Wallen is the founding Shareholder at Wallen Kelley, a leading litigation, trial, and appellate boutique law firm based in Florida.

With more than 25 years of experience, Todd represents individuals, public companies, and private corporations nationwide in complex, high-exposure litigation involving product liability, construction defects, crane and construction equipment, pharmaceutical products, toxic torts, automotive and trucking accidents, insurance coverage, and commercial disputes.

A veteran trial lawyer, Todd has tried cases involving automobile accidents, product liability, chemical exposure, carbon monoxide, and first-party homeowners insurance. He has also argued more than eighty appeals in state and federal courts. His representative appellate matters include:

Todd earned his Bachelor of Arts in Economics from Middlebury College in 1995 and his Juris Doctor from the University of Miami School of Law in 1998. Following law school, he served as a law clerk to the Honorable David M. Gersten at the Third District Court of Appeal of Florida (1998–1999).

He joined Shook Hardy & Bacon LLP, where he became a partner and spent more than a decade (1999–2013) defending major pharmaceutical companies, tobacco manufacturers, and chemical producers in complex product liability and mass tort litigation. From 2014 to 2016, Todd served as President of The Wallen Law Firm, P.A., and later he was a Founding Partner of Wallen Hernandez Lee Martinez, before co-founding Wallen Kelley.

Todd is admitted to practice in Florida, the U.S. District Court for the Southern District of Florida, the U.S. Courts of Appeals for the Ninth and Eleventh Circuits, and the U.S. Court of Appeals for the Federal Circuit.

Product manufacturers, distributors, and retailers can be held liable when product that they put on the market cause injury or death. Products liability claims may focus on product design, manufacturing defects, or because of inadequate warnings or instructions. The causes of action are generally negligence, strict liability, and, in some instances, breach of warranty. The strict liability cause of action lessens the burden of proof for the injured victim-the plaintiff only needs to prove that there is a defect in the product and that the defect caused an injury. If established, the defendant is considered fully responsible regardless of whether it knew or should have known of a problem with the product and acted in a reasonable manner.
